Navigating TITP Regulations: Key Laws & The Future of Japan's Training System
Understanding and complying with the legal framework governing the Technical Intern Training Program (TITP) is paramount for ensuring a successful, ethical, and secure experience for both host organizations and technical interns. The regulatory landscape surrounding TITP is currently undergoing significant and fundamental reforms, making expert guidance more critical than ever.
At YS Support Cooperative, we stay at the forefront of these legislative changes. We ensure all our partners and interns operate within the current legal boundaries while preparing for the shift to Japan’s new foreign talent development system.
Foundational Laws Governing the Current TITP
While a new system is on the horizon, the current TITP operates under specific Japanese laws and regulations that ensure its proper implementation and the protection of technical interns’ rights. Key legislation includes:
- The Technical Intern Training Act (技能実習法): This is the core law that outlines the program’s purpose, the responsibilities of host organizations and supervising organizations, and measures for protecting technical interns. Its primary aim is to ensure the proper transfer of skills and technology.
- Immigration Control and Refugee Recognition Act (入管法): This act governs the visa status of technical interns, their entry into Japan, period of stay, and departure procedures. All activities must comply with this fundamental immigration law.
- Labor Standards Act (労働基準法) & Minimum Wage Act (最低賃金法): Technical interns are considered laborers under Japanese law, and thus are protected by general labor laws. This includes regulations on working hours, breaks, holidays, occupational safety, and ensuring they receive at least the regional minimum wage.
- Industrial Safety and Health Act (労働安全衛生法): This law mandates that host organizations provide a safe and healthy working environment for all employees, including technical interns, and ensure proper safety training.
- Social Security Laws: Interns are typically enrolled in Japan’s national health insurance and pension systems, ensuring access to medical care and future benefits.
Major Reforms Underway: The Shift from TITP to "Ikusei Shuro" (育成就労制度)
Japan has officially passed legislation to abolish the current Technical Intern Training Program (TITP) by 2027, replacing it with a new framework called the “Ikusei Shuro” (Training and Employment Program). This marks a significant pivot in Japan’s foreign labor policy, driven by a need for a more sustainable and humane system.
Key Changes Proposed in the New System:
- Shift in Purpose: The new program’s primary purpose shifts from “international contribution through skill transfer” to “securing and nurturing human resources for Japan’s industries.” This explicitly acknowledges foreign workers as essential labor.
- Enhanced Worker Protections & Mobility: The new system aims to significantly improve worker rights, notably by allowing greater flexibility for interns to change employers within the same industry after fulfilling certain conditions (e.g., one year of employment and passing basic skills/language tests). This addresses a major criticism of the TITP’s restrictive nature.
- Pathway to Specified Skilled Worker (SSW): The Ikusei Shuro program is explicitly designed to serve as an entry point, providing a clearer and more integrated pathway for foreign workers to transition into the long-term SSW program upon completing their initial training.
- Targeted Industries: The new system’s target industries will align with the expanded fields of the SSW program, focusing on sectors with critical labor shortages (expected to be around 14 fields).
- Stronger Oversight: The existing supervising organizations will be reformed into “supervision and support organizations” with enhanced monitoring and support functions to prevent exploitation.
Transition Period: The move from TITP to Ikusei Shuro will be gradual, with a transition period expected until approximately 2030, during which both systems may coexist. Host organizations and interns currently under TITP will generally continue under the old system until their program completion, with specific rules for potential transitions.
